1. Acceptance of Terms
By accessing, or using Dailycal LTD (the “Service”), you agree to these Terms and Conditions (the “Terms”) and to comply with all applicable laws and regulations. These Terms form a legally binding agreement between you and Dailycal LTD company. If you disagree with these Terms, do not use the Service. Continued access and use of the Service imply your acceptance of any modifications to these Terms. We recommend regularly reviewing these Terms to stay informed of any changes.
2. Service Overview
Dailycal LTD provides a platform for Users (individuals, businesses, and service providers) to schedule, book, and manage appointments online. Through this Service, Users can manage their schedules, send reminders, and facilitate client bookings, though Dailycal LTD.app itself does not facilitate payment transactions between Hosts and Clients. Any user interactions, transactions, or services rendered are solely between the Client and Host, and Dailycal LTD bears no responsibility for such interactions.
3. Subscription, Payment, and Fees
- Subscription Fees and Billing: The Service operates on a freemium model, offering both free and paid subscription tiers. Subscription fees are billed on a recurring basis (monthly or annually), as detailed on our website or in the app. Fees and billing cycles may be updated and it’s all done by Stripe, and Users will be notified in advance of any rate adjustments that impact future billing cycles.
- Cancellation Policy: Users can cancel their subscriptions through the account settings. Cancellations are effective at the end of the current billing period, and we do not offer refunds for partially used periods or unused features.
- Host-Managed Transactions: Dailycal LTD only facilitates the scheduling and booking functions of the Service. Any booking fees, refunds, or payment processing must be handled directly by the Host and the Client through an external payment platform (Stripe). Dailycal LTD disclaims any liability for disputes, missed payments, or refund issues that arise between Hosts and Clients. Users agree to resolve such matters independently of the Service.
4. User Responsibilities and Acceptable Use
- Account Security: Users are solely responsible for maintaining the confidentiality of their login credentials and account information. You must promptly notify us of any unauthorized access to or misuse of your account.
- Compliance and Prohibited Actions: Users agree not to engage in any actions that:
- Violate applicable federal, state, or international laws.
- Use bots, spiders, or other automated methods to access, monitor, or copy data from the Service.
- Introduce malicious software (viruses, worms, or trojans) or attempt unauthorized access to the Service or other Users’ data.
- Engage in abusive conduct, including but not limited to harassment, impersonation, and spreading false or misleading information.
- Content Use: The Service and its content are protected by intellectual property laws. Users may not reproduce, distribute, create derivative works from, publicly display, or publicly perform the Service or any of its content without express written permission.
5. User Content and Intellectual Property Rights
- User-Submitted Content: Users can submit reviews, comments, and other content (“User Content”). Users agree not to post content that is illegal, defamatory, obscene, or infringes on third-party rights. By posting User Content, Users grant Dailycal LTD a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt the content for marketing, research, or Service improvement purposes.
- Copyright and DMCA Compliance: We respect the intellectual property rights of others. Users who believe that their copyrighted material has been used without authorization can contact us with a DMCA-compliant notice to request removal. 6. Limitation of Liability and Disclaimers
- No Warranty: Dailycal LTD provides the Service on an “as-is” and “as-available” basis without warranties of any kind. We disclaim all express, implied, or statutory warranties regarding the Service, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of Liability: To the fullest extent permitted by law, Dailycal LTD is not liable for any indirect, incidental, punitive, or consequential damages resulting from Service use, including but not limited to data loss, profit loss, or service interruptions. Liability is limited to the amount of subscription fees paid in the six months preceding the claim.
7. Changes to Terms
Dailycal LTD reserves the right to modify these Terms at any time. Updates will be posted on the website, and Users are encouraged to review the Terms periodically. Continued use of the Service constitutes acceptance of any modified Terms.
